DELIVERY and SHIPMENT
3.1 Any dates given for delivery by the Company are estimates only and the Company shall not be responsible for any delays.Unless Buyer pays extra for guarantee date of delivery, any delivery delays will not be responsible by the Company. If Buyer wants guarantee delivery date, Buyer must contact the Company shipping department for added charges and terms before shipment leaves our facility.
If there are shipping delays, resulting from missed appointments, weather, mechanical, medical, inaccessible roads or for any unnamed reasons by Buyer or third party shipping company, Buyer is still responsible for arranging delivery appointment with third party shipping company. If Buyer cancels due to shipping delays for any reason, Buyer is fully responsible for shipping charges in both directions.
3.2 All Contracts entered into where stock permits will be sent for normal 5-8 bus iness day delivery. Should the Buyer require an improved service this will be subject to availability. The Company will make an increased charge.
3.3 The Company reserves the right to make delivery by installments and will obtain agreement either verbally or in writing from the buyer. In the event that these conditions shall apply each delivery will be treated as though it were the subject of a separate contract and failure by the Company to deliver any one or more installments or any claim by the Buyer in respect of any one or more installments shall not entitle the Buyer to treat the contract as a whole as repudiated.
3.4 Delivery shall be affected at the time when the Buyer collects the goods from the Company or in cases where delivery is to be carried out by the Company at the request of the buyer is made to the address specified by the Buyer. The Buyer shall inspect the Goods on delivery. Where the buyer is reselling goods for direct delivery to a third party it is the buyer’s responsibility to organize the inspection of goods. If the Buyer shall give written notice as aforesaid the buyer shall comply with the Company’s instructions concerning the return or retention for inspection of such Goods, which shall be at the Buyer’s risk until back in the possession of the Company.
3.5 All requests for proof of delivery must be made within 5 working days of the delivery due date.
3.6 For trampoline orders, shipments will be shipped via freight curbside delivery. Curbside delivery means that you are responsible for getting the equipment from the back of the truck to your home. You must be home at the time of delivery. It is your responsibility to make the delivery arrangements with the trucking company. Please note, date set forth on carriers online tracking system are based on estimation by the 3rd party carrier and not the responsibility of Happy Trampoline and its representatives. Typical protocol requires 3rd party ca rrier to contact customer beforehand to schedule an appointment prior to delivery. In the event communication was not made from carrier to customer for various reasons (incorrect phone #, scheduling delayed, etc.), it is the customer’s responsibility to contact the carrier to coordinate delivery appointment time. During peak seasons, there will be unforeseen delays that may be beyond the control of the shipping carrier. Customers have the option to contact carrier in advance to schedule a drop-off time before hand to eliminate any possible lag time to expedite delivery time. Happy Trampoline will do everything we can to trouble shoot any mishaps and delays. Any verbal statements made by our representatives regarding shipping times will be in no way hold us responsible for any delays. Once item leaves our warehouse, responsibility of shipment will be transferred into the hands of customers. We use either UPS, fedex, or any 3rd party carrier of our own choosing. In the event that your delivery location is not accessible by the shipping freight truck, carrier will have the discretion to use best judgment, which could be at the end of driveway, end of street or beyond your curbside. Happy Trampoline is in no way responsible for drop-off arrangements, delays, extra charges, or issues resulting thereof. If you would like to utilize the extra services, such as lift gate and/or inside delivery, there will be additional charges. These charges are your responsibility and are not included in items with free freight.
